1.1. Applicable normative

Our Privacy Policy has been developed in accordance with the EU General Data Protection Regulation 2016/679 by the European Parliament and Council of 27 April 2016, which regards the protection of natural persons on personal data processing and on the free circulation of these data, and which repeals the 95/46/CE Directive (General Data Protection Regulations). It has also been developed in accordance with the provisions of the Spanish legislative framework on the Protection of Personal Data that are not contradicted by the aforementioned Regulation. 

By providing your data, you declare to have read and understood our Privacy Policy, giving us your unequivocal and express consent to process your personal data in accordance with the purposes and terms expressed herein. 

The Company may be able to modify the current Privacy Policy in order to adapt it to the new legislation, jurisprudence or interpretation of the Spanish Data Protection Authority. These privacy terms may be complemented by the Legal Notice, Cookies Policy and General Conditions that, when applicable, are applied to certain products or services, if such access involves any special conditions in the protection of personal data.

2. PURPOSE OF PERSONAL DATA PROCESSING

The processing of your personal data has the following purposes:  

Provide you with related information to the products and services of our company and that are detailed in this website.

Hire our services by the acceptance of the corresponding estimate/order and/or commercial contract signing.

Receive news and information about novelties in our entity via email and/or mail, as well as updates in our product and service catalog. 

2.1. Time for data retention

We shall keep your personal data from the moment you give consent until you revoke it or request a limitation of the processing.  In such cases, we shall keep your data blocked for the legally required periods of time.

3. LEGITIMIZATION AND COLLECTED DATA

The legitimization for your data processing is the express consent given by a positive and affirmative action (filling the corresponding form and checking the box to accept that policy) when you provide your personal data.

3.1. Data processing consent

When you fill the forms, check the box “I agree to this Privacy Policy” and click to send your data, or when you send emails to the Company via enabled accounts for these purposes, the User confirms to have read and expressly agreed to that privacy policy, and give their unequivocal and express consent to the processing of their personal data according to the mentioned purposes. The User confirms to be over 14 years old and thus possesses the legal capacity needed to give consent regarding the processing of personal data, according to the provisions of this Privacy Policy.

3.2. Data categories

The collected data belong to the identification category, such as: name and surname, telephone, address, company, email, as well as the IP address from which the data collection form is accessed.

4. SECURITY MEASURES

Due to our commitment to ensure security and confidentiality on your personal data, we inform you that the necessary technical and organizational measures have been adopted to  guarantee the security of your personal data and to avoid their alteration, loss, non-authorized processing or access, in view of the state of technology, the nature of the collected data and the risks to which it is exposed, following the Article 32 of EU GDPR 679/2016.

5. DATA TRANSFER

No national or international data transfers are foreseen, except for those authorized by the tax, commercial and telecommunication legislations and for those cases in which a judicial authority requires us to do so.

6. USER RIGHTS

Any interested party has the right to obtain confirmation whether we are processing personal data concerning them or not. The interested persons have the right to access their personal data, as well as to request the rectification of their imprecise data or, when appropriate, to request their deletion if, among other reasons, the data is no longer needed for the purpose they were collected to.  Under certain circumstances, the interested parties shall request the limitation of their data processing, when we shall only keep them for the execution or defense of complaints. For reasons related to their particular situation, the interested parties can oppose the processing of their data. 

The Responsible party for the file shall stop processing the data, except for legitimate imperative reasons, or the exercise or defense of possible complaints.

According to the current legislation you have the following rights: right to request access to your personal data, right to request their rectification or deletion, the limitation of their processing, right to data portability, as well as to revoke the given consent. 

6.1. How do I exercise my rights?

To exercise your rights you may send a notice to Paseo Pedro Ponce 121 Oficina 14, 04700 El Ejido, Almería or you may email the Responsible party or, when appropriate, the Data Protection Officer at info@treze.es, requesting the corresponding form to exercise the selected right. Optionally, you can contact the competent Control Authority to obtain additional information about your rights.

Remember to attach a copy of a document that allows us to identify you.

7. CONSENT TO ELECTRONIC COMMUNICATIONS

Likewise, and according the provisions of 11 July 34/2002 Law by the Information Society and Electronic Commerce Services, by filling the data collection form and checking the box “I agree to receive electronic communications”, you are giving your express consent to receive information about the Company via email, telephone, fax or other electronic means.
